Participant Agreement, Release, and Assumption of Risk

Please carefully read the following waiver before proceeding.

Ross Point Challenge Course Eligibility

  • Climbing Wall: Ages 7 and older
  • High Ropes Course: Ages 12 and older depending on physical stature required to reach overhead cables and ropes
  • Maximum Weight Limit: 300 lbs. to participate on the high ropes course, 250 lbs. to participate on the zip line or giant swing
  • Team Building Initiatives: Ages 12 and older

In consideration of the services of Ross Point Camp & Conference Center, their agents, owners, officers, volunteers, participants, employees, and all other persons or entities acting in any capacity on their behalf (collectively referred to as "Ross Point"), I hereby agree to release, indemnify, and discharge Ross Point on behalf of myself, my spouse, my children, my parents, my heirs, assigns, personal representative, and estate.

The following agreement contains important information regarding risks associated with participation in challenge course activities, assumption of risk, release of liability, indemnification, medical responsibility, and legal rights. Please read the entire agreement before continuing.

By continuing to the next page and submitting this form, you acknowledge that you have read, understood, and agree to be bound by the terms of the Participant Agreement, Release, and Assumption of Risk.

Challenge Course Eligibility

Challenge Course Requirements

For the safety of all participants, Ross Point Camp & Conference Center has established the following participation requirements:

  • Climbing Wall: Participants must be 7 years of age or older.
  • High Ropes Course: Participants must be 12 years of age or older and physically capable of reaching overhead safety cables and ropes.
  • Team Building Initiatives: Participants must be 12 years of age or older.

Weight Limits

  • High Ropes Course: Maximum participant weight is 300 pounds.
  • Zip Line: Maximum participant weight is 250 pounds.

Challenge by Choice

Ross Point Challenge Course activities are based on the principle of Challenge by Choice. Participants are encouraged to challenge themselves at their own comfort level. Participation in any activity is voluntary, and participants may choose to stop participating at any time.

Safety Expectations

All participants are expected to follow staff instructions, wear provided safety equipment correctly, and act in a manner that promotes the safety of themselves and others. Failure to follow safety instructions may result in removal from the activity.

Participant Agreement, Release, and Assumption of Risk

In consideration of the services of Ross Point Camp & Conference Center, their agents, owners, officers, volunteers, participants, employees, and all other persons or entities acting in any capacity on their behalf (collectively referred to as "Ross Point"), I hereby agree to release, indemnify, and discharge Ross Point on behalf of myself, my spouse, my children, my parents, my heirs, assigns, personal representatives, and estate as follows:

1. Acknowledgment of Risk

I acknowledge that my participation in challenge course activities entails known and unanticipated risks which could result in physical or emotional injury, paralysis, death, or damage to myself, property, or third parties.

These risks include, but are not limited to:

  • Slips, trips, falls, and falling from heights
  • Rope burns, scrapes, cuts, bruises, and sprains
  • Fractures, concussions, and other serious injuries
  • Exposure to plants, insects, animals, and environmental hazards
  • Equipment failure or malfunction
  • Weather-related hazards
  • Human error by participants, staff, or facilitators

I understand that these risks cannot be completely eliminated without fundamentally changing the nature of the activity.

2. Assumption of Risk

I expressly agree and promise to accept and assume all risks existing in the activity. My participation is voluntary, and I choose to participate despite these risks.

3. Release and Indemnification

I voluntarily release, forever discharge, and agree to indemnify and hold harmless Ross Point Camp & Conference Center from any and all claims, demands, causes of action, damages, losses, or expenses arising out of my participation in challenge course activities or use of Ross Point facilities and equipment.

4. Attorney Fees and Costs

Should Ross Point or anyone acting on its behalf incur attorney fees or costs to enforce this agreement, I agree to indemnify and hold them harmless for all such fees and costs.

5. Medical and Insurance Responsibility

I certify that I have insurance to cover any injury or damage I may cause or suffer while participating, or I agree to bear the costs myself. I further certify that I am willing to assume all risks related to any medical or physical condition I may have.

6. Severability

If any portion of this agreement is found to be unenforceable, the remaining portions shall remain in full force and effect.

Acknowledgment

By continuing, I acknowledge that if anyone is hurt or property is damaged during my participation, I may be found by a court of law to have waived my right to maintain a lawsuit against Ross Point Camp & Conference Center based on any claim covered by this release.

I have had sufficient opportunity to read and understand this agreement and agree to be bound by its terms.

Please provide accurate medical information. This information will only be used to assist Ross Point Camp & Conference Center staff in responding appropriately in the event of an emergency.
